The goods

The subject of the contract is mechanical breathing training aids, respiratory resistance instruments, accessories for mindful breathing, and access to specific, trainer-led online learning units for breathing practice and physical relaxation. Ordering and contract

Clicking the final order button places a binding order. We confirm receipt electronically; the agreement takes effect upon handover to the carrier. Should a product be out of stock or details cannot be matched, we reserve the right to decline; advance payments will be refunded immediately.

Prices and payment

All prices are in EUR including applicable VAT. Shipping costs are displayed at checkout before the final click. Payment methods: Cash on delivery, Bank transfer. In the event of an obvious pricing error, we will correct the amount before dispatch and let you choose whether to proceed or cancel.

Product images and colours

Our images display the actual items crafted in our workshop. Slight color variations due to monitor settings, browser windows, or ambient daylight cannot be fully avoided from a technical standpoint; such minor shade differences do not qualify for a free return or purchase refund. Exact dimensions, glass and silicone materials, and package contents are listed directly with each product.

Transfer of risk

Until the courier hands the parcel to you or an authorized recipient at your door, we retain responsibility for transit. After that point, the risk of damage or loss passes to you. Please have any obvious damage to the box noted immediately and notify us within 48 hours.

Returns and warranty

Returns of unused items in their original packaging are accepted within 30 days of receipt in accordance with our return guidelines. The statutory warranty provisions of the Republic of Austria apply in accordance with the General Civil Code (ABGB) and the Consumer Protection Act (KSchG). In the event of defects in breathing devices or accessories, consumers primarily have the right to free repair or replacement, and secondarily to a price reduction or cancellation of the contract.

• Goods made to customer specifications or clearly customized to personal needs
• Goods that can spoil quickly or whose expiration date would be exceeded quickly
• Sealed goods such as breathing trainers, mouthpieces, mask attachments, or filters that are not suitable for return for reasons of health protection or hygiene if their seal was removed after delivery
• Goods that, after delivery, were inseparably mixed with other goods due to their nature
• Digital content such as personalized video breathing courses and audio training guides, provided the consumer expressly consented before the withdrawal period expired and delivery has begun

Liability

Calmavita is liable without limitation for damages caused intentionally or through gross negligence, as well as for personal injury. In cases of slight negligence, liability is limited to typical, foreseeable contractual damages, up to a maximum of the total value of the respective merchandise order or an amount of 100,00 €. No clause in these agreements affects or limits liability to the extent that an exclusion is prohibited by law.

Age and use

A minimum age of 18 years applies to orders in our shop. Please always use the training devices according to the leaflet and label; they never replace diagnosis or therapy by a doctor.

Governing law and disputes

The law of the Republic of Austria applies to all legal relationships between the contracting parties, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection regulations of the consumer's country of residence remain unaffected. If an amicable settlement cannot be reached in the event of a dispute, the court at the seller's registered office shall decide, provided that mandatory consumer protection regulations of your country of residence do not conflict with this.
